Purpose and legal basis

INA §208 contains the general one-year asylum deadline and exceptions. Form I-589 also covers withholding of removal, which differs from asylum. Affirmative cases may be handled by USCIS; defensive cases may be handled by EOIR. Check the current instructions for the correct filing route and additional protections.

Before filing

Use the official USCIS form page to verify the currently accepted edition, instructions, filing address and fees. Historical announcements may no longer describe today’s requirements. Review signatures, supporting documents and any deadlines before sending a packet. A pending application is not the same as an approved immigration benefit.
