Purpose and legal basis

INA §216 governs covered marriage-based conditional residence. The ordinary joint petition is filed during the 90-day period before the second anniversary of conditional residence. Certain waiver routes exist for qualifying circumstances; divorce or abuse does not automatically resolve every requirement.
